1. Eligibility & Account Security

You must be at least 18 years of age to create an account or use our services. By using WakaLess, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2. Property Requests & Agent Engagement

WakaLess acts as a facilitator between Users seeking property and Verified Agents.

• Notification Consent: When a User submits a property request, our system transmits real-time push notifications and data to Verified Agents within the relevant category or location.
• Data Accuracy: Users agree to provide accurate, current, and complete information in their requests.
• No Guarantee: While we strive for efficiency, WakaLess does not guarantee that every request will result in a successful property match.

3. Verified Agent Conduct

Agents registered on the platform are independent contractors and not employees of WakaLess. Agents agree to:

• Represent properties accurately and truthfully.
• Respect User privacy and only use contact data for the intended purpose of fulfilling a request.
• Adhere to local real estate laws and ethical standards in Nigeria.

5. Fraud & Transactional Liability

WakaLess provides Safety Tips and guidelines prominently across the platform. It is the User’s absolute responsibility to adhere to these safety protocols.

• No Liability for Fraud: WakaLess shall not be held liable for any financial loss, fraud, or misrepresentation committed by an agent.
• Outside Transactions: We strictly advise against making payments for properties before physical inspection and verification of title documents. Any transaction carried out between a User and an Agent is a private contract therefore, users are solely responsible for conducting due diligence before entering into any transaction; WakaLess is not a party to such transactions and cannot recover funds lost to fraudulent third parties.

6. Limitation of Liability

To the maximum extent permitted by law, WakaLess, its directors, and employees shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of the platform, including but not limited to disputes between Users and Agents or the quality of physical properties inspected.

7. Dispute Resolution & Law Enforcement Cooperation

WakaLess is a neutral platform that facilitates connections between Users and independent Agents. In the event of any dispute, fraud, or alleged misconduct between Users and Agents, WakaLess does not mediate or assume responsibility for resolving such disputes. However, WakaLess reserves the right to investigate reports of suspicious or fraudulent activity on the platform. Where necessary, and upon receiving a valid legal request or directive from law enforcement or regulatory authorities, WakaLess may disclose relevant user or agent information, including but not limited to account details, activity logs, communication records, and technical identifiers, in compliance with applicable laws. By using the platform, you consent to such disclosure where required for the purposes of fraud prevention, investigation or legal compliance.

8. Termination of Access

WakaLess reserves the right to restrict, suspend, or permanently remove agents based on user complaints, suspicious activity, or internal risk assessment, without obligation to disclose full investigation details.

9. Governing Law

This Agreement shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
